Managed care was considered one strategy to address the two central issues identified as major concerns: 1. Could managed care help curtail Medicaid liability growth? 2. Could managed care provide a better continuum of care to Medicaid recipients? Lawmakers interested in exploring these two questions requested the creation of a Task Force to explore, without predisposition, the use of managed care within the Illinois Medicaid program to determine what, if any, improvements would be applicable and feasible. For this reason, the Managed Care Medicaid Task Force was created. Part 2 of this 2006 Case Report contains all the Illinois statutes that LRB research has found that have been held unconstitutional and remain in the Illinois Compiled Statutes without having been changed in response to the holding of unconstitutionality. Part 3 of this 2006 Case Report contains Illinois statutes that are representative of i statutes that were held unconstitutional and then changed in response to the holding of unconstitutionality or ii statutes that were construed in a particular way in order to avoid a holding of unconstitutionality. Part 3 does not include every such statute. Part 3 includes statutes that i currently appear or formerly appeared in the Illinois Compiled Statutes or appeared in an Act that was replaced by an Act that currently appears in the Illinois Compiled Statutes and ii may have some instructional value concerning the requirement that statutes not violate the United States Constitution or the Illinois Constitution.
